Terms of Service
These terms are the agreement between you and LiveSheet. They are written to be read rather than survived, and the section that matters most to a working musician is the one about the stage.
1 · Who you are agreeing with
LiveSheet is a product of love, made and operated by Amit Jurgenson and Ori Weinstock, musicians and software developers ("we", "us"). By creating an account or using LiveSheet, you accept these terms. If you do not accept them, do not use it.
2 · What LiveSheet is
LiveSheet is a sheet music reader and editor. Its LiveTrack feature listens through your device's microphone and follows you through the chart as you play. LiveSheet comes in two plans: Player, which comes with the app, and Pro, a paid subscription that adds sync, web access and more export formats. It is single-user and still being actively developed.
LiveTrack is in Beta. During the Beta it is open to every user. How LiveTrack is offered may change when the Beta ends. What the app sends us about how LiveTrack followed you is described in the Privacy Policy.
On stage, it is an assistant and not an autopilot. LiveTrack follows audio in a real room, which is a hard problem with no perfect answer: a loud room, an unusual arrangement, a tempo nobody agreed on, or a microphone pointed the wrong way can all make it lose its place. You remain responsible for your own performance. Do not use LiveSheet in a situation where being on the wrong bar would be unacceptable and you have no way to recover. Know the song, keep a hand near the screen, and treat the following as help rather than as a guarantee.
3 · Your account
You can use LiveSheet without an account; your library then stays on your device. To use Pro you sign in with Apple or Google. One account is one person, so do not share it. Keep the Apple or Google account you sign in with secure, since whoever can sign into it can reach your library. You must be at least 16 to have an account.
3a · Pro subscriptions
Pro is an auto-renewing subscription, billed monthly or yearly through your Apple ID at the price shown in the app before you buy. Apple handles the payment, renewal, cancellation and refunds under its own terms. A subscription renews unless you cancel it at least 24 hours before the end of the current period, in your Apple ID's subscription settings. Deleting your LiveSheet account does not cancel it.
If a subscription ends, you go on using LiveSheet with Player. Each of your devices keeps its own copy of your library as it was at that moment, and from then on the copies are no longer kept in sync with each other. Prices may change; a change applies from your next renewal, and Apple tells you in advance where the law requires it.
4 · Your content, and the rights to it
Your charts are yours. Everything you create in LiveSheet (charts, setlists, shows, annotations) remains your property. You grant us only the narrow permission needed to run the service: to store your content, and to transmit and display it back to you and to devices you are signed in on. Without an account your content stays on your device, and we never receive it. We claim no ownership and we do not show your content to anyone else. We do not use your charts, lyrics or files to train anything, with one narrow exception: when LiveTrack follows a chart, the chord structure it was following (the chords, bar by bar, without the title or any words) may be used to improve LiveTrack, as the Privacy Policy describes. If you send us a report as a beta tester, we use what is in it to fix what you report, and a recording you choose to attach may be kept as test material for LiveTrack until you ask us to delete it.
Copyright in the songs is your responsibility. A chord chart may describe a song that somebody else wrote. You are responsible for having the right to reproduce, store and use any material you put into LiveSheet, including lyrics and any file you import. Do not upload material you have no right to use, and do not use LiveSheet to distribute copyrighted material to other people. If a rights holder contacts us with a valid complaint about specific content, we will act on it.
5 · Acceptable use
Do not use LiveSheet to break the law, to store or distribute unlawful material, to attack or overload the service, to probe or bypass its security, to access another person's account or data, or to resell access to it. Automated scraping or bulk extraction is not permitted.
6 · Availability, changes and your data
LiveSheet is provided as it is, with no promise of uninterrupted availability. Features may change, and features may be removed; Beta features especially. If the service is ever going to shut down, we will give reasonable notice and a way to export your charts before it does. You can export your library in the app, or ask for a copy of your data at any time at hello@livesheet.music.
Your performance never depends on our servers. Your library is always stored locally on your device, so LiveSheet needs no connection to work, on stage or anywhere else, and a show is never interrupted by a problem on our side. The only thing a service interruption on our side can affect is syncing between your devices, and it picks up again once we are back.
These terms may change. When they do, the date at the top changes; material changes will be announced in the app rather than left for you to discover.
7 · No warranty
To the fullest extent permitted by law, LiveSheet is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the chart-following engine will be accurate, that the service will be uninterrupted or without errors, or that your data will never be lost. Keep your own copies of anything you cannot afford to lose.
8 · Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost opportunities, lost bookings, or any loss arising from a performance that went badly. Where liability cannot be excluded, it is limited to the amount you have paid us in the twelve months before the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep any rights your local law gives you that cannot be waived by agreement.
9 · Ending it
You may stop using LiveSheet at any time and delete your account in the app (Account settings, Delete my account). We may suspend or end an account that breaks these terms, or that puts the service or its other users at risk; where it is reasonable to do so, we will say why first.
10 · Governing law
These terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa have exclusive jurisdiction, except where the law of your own country of residence gives you the right to bring proceedings there, which these terms do not take away.
